Please read these Terms of Service (“Terms”, “Terms & Conditions”) carefully before using the services provided by Webluno (Pty) Ltd (hereafter referred to as “Webluno”). Your access to and use of Webluno’s services is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all customers, users, and others who use Webluno’s services.

BY ACCESSING OR USING WEBLUNO’S SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DISAGREE WITH ANY PART OF THE TERMS, THEN YOU MAY NOT USE ANY OF WEBLUNO’S SERVICES.

1. Quotes & Estimates

  1. All quotes provided by Webluno are valid for a period of fourteen (14) days from the date of issuance. After the expiration of this Validity Period, the quote shall be deemed null and void. Clients may request a new quote from Webluno at any time following the expiration of the Validity Period. Webluno reserves the right to revise the terms, pricing, and scope of services in any new quote provided after the expiration of the previous quote.

2. Service Fees & Terms

2.1 Website & eCommerce Design Packages

  1. For all website design packages provided by Webluno, a 50% deposit of the total project cost shall be required to initiate the project. The remaining 50% of the project cost shall be payable upon completion and delivery of the website. The project files, website, and contents will not be released or transferred without having received full payment.

  2. The 50% deposit shall apply solely to the base package fees. Any additional services or features beyond the scope of the selected package, such as premium plugins or themes, must be paid in full. These additional costs will be added on top of the initial 50% deposit.

  3. Clients acknowledge and agree to the payment terms outlined herein and understand that failure to make payment according to the specified terms may result in project delays or suspension of services.

  4. Websites will be designed according to the specifications and features outlined in the chosen website design packages. Any features or services included in the packages but not utilized by the client shall not be refunded or credited to the customer’s account. Clients acknowledge and agree that they are responsible for reviewing the package details and selecting the appropriate features and services based on their requirements.

  5. Clients will have fourteen (14) business days from the date of website delivery to review and request changes within the project scope. Any changes requested after the fourteen (14) business day review period shall incur additional fees charged at an hourly rate to make said changes. Clients acknowledge and agree to promptly review the website upon delivery and submit any change requests within the specified review period to avoid additional charges.

2.2 Pay Monthly Website Design Packages

  1. Website design and development will begin upon receipt of the first month’s payment. Clients acknowledge that the first payment is required to initiate the design and development process.

  2. The monthly website design packages are offered on a month-to-month basis. Clients may cancel their subscription at any time by providing Webluno with a minimum of 30 days’ written notice. Cancellation will take effect at the end of the billing cycle following the notice period.

  3. Our monthly website design packages include limited maintenance services:

    Package Option 1&2 provides up to 30 minutes of maintenance per month.
    Package Options 4, and eCommerce provide up to 1 hour of maintenance per month.

    Any maintenance beyond these limits will be billed at our standard hourly rate.

  4. Clients are provided with up to 5GB of storage space. Any storage requirements exceeding 5GB will require the purchase of a separate website hosting package.

  5. Websites provided under the monthly packages are offered on a rental basis. Clients will not gain full access to the website files at any point during the subscription period. Webluno retains full control over the website files to maintain the integrity of the service and the rental agreement.

2.2.1 Pay Monthly Website Packages - Money Back Guarantee

We strive to deliver top-quality website design services that meet your needs. If you are not satisfied with our service, you are entitled to a refund under the following conditions:

  1. Unmet Requirements: If we are unable to meet the specifications and requirements agreed upon at the start of the project, you are eligible for a full refund.

  2. Service Dissatisfaction: If you are not satisfied with our service within the first 7 days, you may request a refund. Simply contact us, and we will process your refund, no questions asked.

  3. Change of Mind: Refunds will not be provided if you change your mind after the service has been substantially delivered.

  4. Scope Changes: If the project scope is altered or additional requirements are introduced after the initial agreement, refunds will not apply to these changes.

  5. Completion of Work: If the website design project is completed and delivered as per the agreed specifications, a refund will not be granted.

  6. Delayed Communication: Failure to communicate necessary information or approvals in a timely manner may void eligibility for a refund.

  7. Third-Party Issues: Issues caused by third-party services or providers are not covered by our money-back guarantee.

We are dedicated to ensuring your satisfaction and will work diligently to resolve any issues you may encounter. If you have any questions about our refund policy, please contact our support team.

2.3 Website Maintenance Services

  1. For clients opting for website maintenance services without a maintenance package, a 100% upfront payment will be required before services are provided. Clients acknowledge and agree to make full payment prior to the commencement of any maintenance activities. Failure to make payment may result in delays or suspension of maintenance services.

  2. Maintenance services will be provided within 24 hours of receipt of maintenance requests.

  3. Any maintenance services not outlined in the original request or maintenance package will be charged at an additional hourly rate. Clients acknowledge and agree to the additional charges for services beyond the scope of the original request or maintenance package.

  4. Maintenance packages that run out of support hours will be charged at a discounted hourly rate. Clients acknowledge and agree to the discounted hourly rate for maintenance services provided beyond the allocated support hours.

  5. Website maintenance support hours shall not carry over to the following month and will reset at the beginning of each month. Webluno will keep track of support hours used by maintaining a timesheet.

2.4 Search Engine Optimization (SEO)

  1. For clients engaging in SEO services, a 100% upfront payment is required before any SEO services are commenced on the client’s website. Clients acknowledge and agree to make full payment prior to the initiation of any SEO activities. Failure to make payment may result in delays or suspension of SEO services.

  2. The SEO services to be provided are laid out in the SEO packages offered by Webluno. Clients acknowledge and agree to the scope of SEO services outlined in the selected SEO package. Any additional services beyond the scope of the chosen package may be subject to additional fees as outlined in the package details or agreed upon separately.

  3. The client agrees to provide Webluno with all materials and content necessary to perform the SEO services. Clients acknowledge and agree that timely provision of materials and content is essential for the effective execution of SEO strategies.

  4. The client’s collaboration with Webluno is essential to ensure a successful SEO campaign. Failure to collaborate effectively may negatively affect SEO results and performance. Clients acknowledge and agree that active participation, timely feedback, and provision of necessary information are crucial for the effectiveness of the SEO campaign.

  5. Clients acknowledge that Webluno does not guarantee SEO results or sales from our services. While Webluno will do the best we can to optimize the website and improve its visibility in search engine results, the effectiveness of SEO efforts can vary based on various factors beyond our control, including but not limited to changes in search engine algorithms, industry competition, and market fluctuations.

  6. The client agrees that for a successful campaign, they have to make use of SEO services for at least six (6) months. Although our packages are month-to-month, we recommend six (6) months for the best performance. Clients acknowledge and agree that SEO is a long-term strategy, and consistent efforts over an extended period are necessary to achieve significant and sustainable results.

  7. Failure to make payment will result in all campaigns being paused until full payment is received.

2.5 Pay Per Click Advertising/Marketing

  1. Pay-per-click (PPC) services provided by Webluno will include advertising services for Facebook and Google platforms. Clients acknowledge and agree that PPC campaigns may encompass various advertising formats, targeting options, and budget management strategies on both Facebook and Google platforms.

  2. For pay-per-click (PPC) services provided by Webluno, a 100% upfront payment is required before services will start. Clients acknowledge and agree to make full payment prior to the commencement of PPC campaigns. Failure to make payment may result in delays or suspension of PPC services.

  3. The client agrees that they will be responsible for managing their own platform budgets, and Webluno’s management fee will be billed separately. If the client wants Webluno to manage their advertising credit, an additional fee of R500 or 2% management fee (whichever is more) will be applied.

  4. Webluno cannot guarantee results but will do the best they can to optimize the performance of PPC campaigns. While Webluno strives to achieve the best possible outcomes for clients, factors such as market conditions, competition, and changes in platform algorithms may impact campaign performance. Clients acknowledge and agree that results may vary, and Webluno cannot guarantee specific outcomes or levels of success.

  5. PPC services require collaboration from the client, and no collaboration will negatively impact the performance of the campaigns. Clients acknowledge and agree that active participation, timely feedback, and provision of necessary information are crucial for the effectiveness of PPC campaigns. Failure to collaborate effectively may result in suboptimal campaign performance.

  6. PPC services will include all features as per the packages listed on our website. Clients acknowledge and agree that the scope of PPC services will be based on the features and options outlined in the selected package. Any additional services beyond the scope of the chosen package may be subject to additional fees as outlined in the package details or agreed upon separately.

  7. Failure to make payment will result in all campaigns being paused until full payment is received.

3. Payments

  1. Payments for services are to be made by Electronic Funds Transfer (EFT) or Debit Order. Clients acknowledge and agree to make payments via these methods according to the terms outlined in the payment schedule. Some services may only be eligible for Debit Order payments, and clients agree to adhere to this requirement for such services.

  2. Debit orders will only be processed on the first of the month and are subject to the debit order mandate terms agreed upon by the client. Clients acknowledge and agree that their debit orders will be processed according to this schedule and that adherence to the debit order mandate terms is required for payment processing.

  3. Failed or bounced debit orders will incur an additional penalty fee of R30 per failed transaction. Clients acknowledge and agree to this penalty fee for failed debit orders and understand that it will be added to the outstanding amount due for the respective payment. 4. Service Cancellations

  1. If the client wishes to cancel their services, they will be required to submit at least a 30-day written notice where applicable. Debit orders can only be cancelled before the 15th of each month due to the way that debit batches are processed. Webluno will not refund customers for debit orders that are not cancelled before the 15th of each month; instead, the payment will be cancelled the following month, but services will still be rendered for said month.

  2. Service cancellations will be respective of service payment terms as outlined in this document. Clients acknowledge and agree that cancellation requests will be subject to the payment terms specified herein. Failure to adhere to the specified cancellation terms may result in additional charges or penalties as outlined in this document.

5. Suspension & Termination

  1. Webluno reserves the right to suspend customer services for failure of payment. Clients acknowledge and agree that failure to make timely payments may result in the suspension of services until outstanding payments are settled. Webluno will make reasonable efforts to notify clients of any impending suspension of services due to payment issues.

  2. Service cancellations will be respective of service payment terms as outlined in this document. Clients acknowledge and agree that cancellation requests will be subject to the payment terms specified herein. Failure to adhere to the specified cancellation terms may result in additional charges or penalties as outlined in this document.

  3. Webluno reserves the right to completely delete or destroy customer services, accounts, and content if no payment has been made for 30 days after service invoices are due. Clients acknowledge and agree that failure to settle outstanding invoices within the specified timeframe may result in the permanent removal of their services, accounts, and associated content from Webluno’s systems.

  4. Webluno cannot be held responsible for damages that may be caused due to payment failure, and the client cannot hold Webluno responsible. It will be the client’s responsibility to ensure that they have backups of their content, not Webluno’s. Clients acknowledge and agree that they are solely responsible for the security and backup of their content, and Webluno bears no liability for any loss of data or damages resulting from payment failure.

6. Design Credit

  1. Webluno reserves the right to include design credit at the bottom of a website’s footer with a link to Webluno’s website. To remove this design credit, a fee of R2,500.00 will be applicable. Clients acknowledge and agree to the inclusion of design credit as specified and understand that removal of the credit will incur an additional fee.

7. Website Hosting

  1. Webluno relies on a third-party company, EliteHost, for website hosting services. The client agrees that if they make use of Webluno’s hosting services, they will also be bound to the terms and conditions of EliteHost. Clients acknowledge and agree to review and comply with EliteHost’s terms and conditions, accessible via the following link: https://www.elitehost.co.za/about/terms-and-conditions 

8. Domain Registration & Renewals

  1. Webluno makes use of EliteHost for domain registration and renewal services. The customer agrees that by using Webluno’s domain services, they will also be bound to the terms and conditions of EliteHost. Clients acknowledge and agree to review and comply with EliteHost’s terms and conditions for domain registration and renewal services. 9. Acceptance

  1. Please note that by submitting your deposit or down payment for our services, you are agreeing to all of Webluno’s terms of service as written here. Webluno reserves the right to change or update these terms at any time without prior notice.

10. Idemnification

  1. Clients agree to indemnify and hold harmless Webluno, its affiliates, and their respective directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from:

    a. Client’s use of and access to Webluno’s services.
    b. Client’s violation of any term of these terms of service.
    c. Client’s violation of any third-party right, including without limitation any copyright, property, or privacy right.
    d. Any claim that client’s content caused damage to a third party.

11. Disclaimer

  1. Webluno shall not be responsible for any damages your business may suffer. Webluno makes no warranties of any kind, expressed or implied, for services we provide. Webluno disclaims any warranty of merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong deliveries, and any service interruptions caused by Webluno and its employees.

12. Disclosure to Law Enforcement

  1. Webluno reserves the right to disclose any information as necessary to satisfy any applicable law, regulation, legal process, or governmental request, or to edit, refuse to post, or to remove any information or materials, in whole or in part, from the services, at Webluno’s sole discretion.

13. Changes to Terms of Service

  1. Webluno reserves the right, at its sole discretion, to modify or replace any part of these terms of service. It is client’s responsibility to check these terms of service periodically for changes. Client’s continued use of or access to the services following the posting of any changes to these terms of service constitutes acceptance of those changes.

14. Abuse

  1. Webluno does not tolerate abuse of its services. Any use of Webluno’s services that is deemed abusive, harmful, or illegal may result in immediate termination of the client’s access to the services without prior notice.
